PRIVACY & INFRINGEMENT NOTICE

1.  PUPOSE. KG ELECTRO-POWER (P) LTD 
KGEP is committed to protecting the privacy and security of your personal information. This privacy notice describes how we collect and use personal information about you during and after your working relationship with us, in accordance with the General Data Protection Regulation (“GDPR”) as well as the Information Technology Act, 2000. The policy is applicable to all KGEP Clients, Partners & Affiliates & Vendors.
2.  DATA MANAGEMENT
KGEP is a “data controller”. This means that we are responsible for deciding how we hold and use personal information about you. We are required under the data protection legislation to notify you of the information contained in this privacy notice. This notice does not form part of any employment contract or other contract to provide services. We may update this notice at any time.
It is important that you read this notice, together with any other documentation we may provide on specific occasions when we are collecting or processing personal information about you, so that you are aware of how and why we are using such information. Any and all information collected is stored within our secured and controlled database.
COLLECTION
We collect personal information about KGEP Clients, Partners & Affiliates and Vendors in the course of running of KGEP, internally, and the performance of our contracts with our clients and suppliers. We may sometimes collect additional information from third parties which may include suppliers, or in order to perform any background or credit checks. This information is also collated with personal data that you actively and voluntarily provide via the several online requests, such as when registering, contacting us with your inquiries, information submitted as part of a support request or participating in surveys etc. Some personal information may also be collected about you from the records of our correspondence and phone calls and details of your visits to our online platforms, including but not limited to personally identifiable information like Internet Protocol (IP) address, KGEP will use such information to identify its users.
We may also use cookies within the online platforms offered by us, Cookies are small files containing certain information that are stored on your device to determine and collect statistics about the behavior of visitors on the platforms. These are necessary to provide certain functionality on a website, by recognizing the device which had previously called up the platform, it gathers information about user’s usage and their presumed interest. This data is then used to improve the platform services therein. Users who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before visiting our platforms.
USAGE
We use the information collected from you to perform the contract we have entered into with you to provide the benefits of being KGEP Clients, Partners & Affiliates and Vendors, KGEP also acts on behalf of said Clients, Partners & Affiliates and Vendors in the capacity of data processor. When working exclusively as a data processor KGEP will act on the instruction of KGEP Clients, Partners & Affiliates and Vendors and will work to ensure that this is carried out in full compliance with GDPR. If you fail to provide certain information when requested, we may not be able to perform the contract we have entered into, with you (such as providing a benefit or service).
CHANGE OF PURPOSE
We shall only use your personal information for the purpose for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal information for an unrelated purpose, we shall notify you and we will explain the legal basis which allows us to do so. Please note that we may process your personal information without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

The legal basis for processing your personal data is to meet KG Electro-Power (P) Ltd’s contractual obligations to its Clients, Partners & Affiliates and Vendors in providing supply and distribution services.

We do not request or need your consent to process your personal data in order to perform our contractual obligations to you. In limited circumstances, we may approach you for your written consent to allow us to process certain data or particularly sensitive data. If we do so, we will provide you with full details of the information, that we would like, along with the reason we need it for, so that you can carefully consider whether you wish to consent. You should be aware that it is not a condition of your contract with us that you agree to any request for consent from us.
5.  INFRINGEMENT POLICY
KGEP is committed to removing infringing content from its online platforms and to facilitate this we have an dedicated single contact-point compliance desk, so that Intellectual Property owners can report listings and contents that infringe their rights. We make this a priority as infringed property erodes trust that we command from our consumers.
We actively respect and support protection of all Intellectual Property rights including Copyrights & Trademarks (“IP”), it is our policy to expeditiously respond to clear notices of alleged Infringement. Our responses to legitimates claims shall include removal of such content and notifying consumers of such infringing activity.
One may report a listing or content via email directly to our compliance team at “compliance@kgep.in”.
