1.  General Terms

This Return and Refund Policy (“Policy”) governs the return, refund, and exchange of products purchased from KG Electro Power (P) Ltd / KGEP Ventures (P) Ltd (hereinafter referred to as “KGEP” or “the Company”). By purchasing products from KGEP, the buyer (“Customer”) agrees to comply with the terms and conditions set forth herein as well as the published “STANDARD TERMS AND CONDITIONS OF SALE FOR PRODUCTS”.

2.  Product Returns

2.1  Eligibility for Returns

A product may be eligible for return under the following conditions:
•  The product is unused, undamaged, and in its original packaging with all original accessories and documentation intact.
•  The product is returned within the applicable return period, as specified by KGEP at the time of purchase.
•  The product is not a custom-made or special-order item.
•  The product has not been installed, modified, or used in any way that affects its resale value.
•  The product is returned in compliance with KGEP’s return authorization and shipping instructions.

2.2  Return Authorization Process
•  Prior to returning any product, the Customer must obtain a written Return Material Authorization (RMA) from KGEP.
•  The request for return must include:
•  The original invoice number and purchase details.
•  A detailed explanation of the reason for return.
•  Photographic evidence or other supporting documentation, if applicable.
•  KGEP reserves the right to approve or reject any return request at its sole discretion.
•  Any product returned without prior authorization will be refused and sent back at the Customer’s expense.

2.3  Non-Returnable Products
The following categories of products are not eligible for return:
•  Custom-built or special-order products.
•  Software, digital products, or electronic components that have been opened or activated.
•  Hazardous materials, chemicals, or products classified as non-returnable due to safety or regulatory reasons.
•  Products that have been damaged, altered, or modified after delivery.
•  Products returned beyond the specified return period.

3.  Refund Process

3.1  Inspection and Approval
•  Upon receipt of the returned product, KGEP will inspect the item to ensure compliance with return conditions.
•  If the return is approved, the Customer will be issued a refund, replacement, or credit-note, as determined by KGEP.
•  If the product does not meet the return conditions, it will be rejected, and the Customer will be responsible for all shipping costs associated with returning the product back.

3.2  Refund Method and Timeline
•  Approved refunds will be processed through the original payment method used during purchase.
•  Refunds will be issued within 10-15 business days from the date of approval.
•  Any applicable restocking fee will be deducted from the refund amount.

4.  Warranty Claims and Defective Products

4.1  Warranty Coverage
•  KGEP warrants that all products are free from material defects and conform to their specifications at the time of delivery.
•  Warranty coverage is limited to manufacturing defects and does not include damages resulting from:
•  Improper installation, misuse, or mishandling.
•  Accidental damage, force majeure events, or unauthorized modifications.
•  Normal wear and tear, including expendable items (e.g., fuses).

4.2  Warranty Claim Procedure
•  Customers must notify KGEP in writing within the warranty period to initiate a warranty claim.
•  KGEP may require the defective product to be returned for inspection.
•  At KGEP’s discretion, the defective product may be:
•  Repaired at no cost.
•  Replaced with an identical or equivalent product.
•  Refunded (full or partial) if repair or replacement is not feasible.

5.  Shipping and Return Costs

5.1  Customer Responsibility
•  The Customer is responsible for all return shipping costs, unless the return is due to an error by
KGEP or a valid warranty claim.
•  If the returned product is lost or damaged in transit, KGEP is not liable, and the Customer should arrange for adequate shipping insurance.

5.2  Shipping Instructions
•  Returns must be shipped to the designated KGEP return facility as provided in the return authorization.
•  All return shipments must be properly packaged and labelled to prevent damage during transit.

6.  Order Cancellations

•  Orders may be cancelled only before shipment, subject to approval by KGEP.
•  If an order is cancelled after shipment, it will be treated as a return, and the Customer will be responsible for return shipping costs and applicable restocking fees.

7.  Liability Limitation

•  KGEP shall not be liable for indirect, incidental, special, or consequential damages arising from the return or refund process.
•  KGEP’s maximum liability for any return or refund claim shall not exceed the purchase price of the product.

8.  Dispute Resolution

•  Any disputes arising from this Policy shall be governed by the laws of Kolkata, West Bengal, India.
•  The parties agree to attempt amicable resolution before pursuing any legal action.
